  1. Website Operator

The website www.edessence.eu (hereinafter the “Website”) is owned and operated by EDESSENCE SRL, an accredited tour operator, having its registered office at No. 49–57 Grigore Gafencu Street, Building A, 6th Floor, Ap. A62, District 1, Bucharest, Romania, registered with the Trade Register under No. J2025073062001.

By accessing and using the Website, you fully and unconditionally accept the present Terms and Conditions.

The Website serves a presentation purpose only, does not allow newsletter subscription, and does not allow the creation of user accounts, online reservations, or direct purchases.

  1. Purpose and Functionality of the Website

The Website www.edessence.eu performs the following functions:

  • presenting tourist programmes and destinations offered by the tour operator;
  • communicating the agency’s contact details;
  • providing visitors with contact / contact forms;
  • offering general information of interest to travellers.

The Website does not constitute an online booking platform. Submission of a request through the contact form shall not constitute a binding reservation, but solely an inquiry for the issuance of a personalised offer.

  1. Intellectual Property Rights

All content of the Website, including but not limited to texts, images, descriptions, databases, graphic elements, the EDESSENCE logo, page structure and any other materials, is protected under copyright and related rights legislation.

Any use, copying, distribution or reproduction of the Website content, in whole or in part, for any purpose whatsoever, is strictly prohibited without the prior written consent of EDESSENCE.

  1. Limitation of Liability

4.1. Informational Nature of the Content

The information displayed on the Website is of a general and indicative nature. Although EDESSENCE makes every effort to ensure the accurate updating of data, errors, omissions or inconsistencies may occur.

4.2. EDESSENCE does not warrant:

  • the permanent accuracy of the published information;
  • the compatibility of the Website with the user’s device;
  • uninterrupted or error-free operation of the Website.

4.3. User’s Liability

Use of the Website is undertaken at the user’s own risk. EDESSENCE shall not be liable for:

  • damages caused by viruses, system errors, server malfunctions or communication network failures;
  • losses arising from the use or the inability to use the Website;
  • any indirect losses, loss of profit or other pecuniary consequences generated by accessing the Website.
  1. Advertising, Confidentiality and Data Protection

Any personal data provided through the Website are processed by EDESSENCE in accordance with Regulation (EU) 679/2016 (GDPR) and the Privacy & Cookie Policy available on the Website.

The user undertakes not to disclose to third parties any information received from EDESSENCE, except in situations permitted by law.

EDESSENCE discloses users’ personal data solely to:

  • competent authorities, on the legal grounds and within the limits of the applicable law;
  • contractual partners involved in the provision of the requested travel services (e.g., hotels, airlines), subject to contractual data protection safeguards.
  1. Links to Third-Party Websites

The Website may contain links to external webpages, including social media accounts.

EDESSENCE shall not be responsible for:

  • the content of such third-party websites;
  • the manner in which such third parties process personal data;
  • any damages resulting from accessing such websites.

Accessing such links is undertaken exclusively at the user’s own risk.

  1. Security and Fraud Prevention

Any attempt to gain unauthorised access to servers, databases or other users’ information, as well as any attempt to alter the Website’s content, constitutes a criminal offence and shall entail criminal liability in accordance with the applicable law.

  1. Traveller’s Rights (Minimum Pre-Contractual Information)

As an accredited tour operator, EDESSENCE ensures travellers all rights granted under national and European legislation on package travel and linked travel arrangements.

At the pre-contractual stage, prior to concluding any contract, the traveller is entitled to receive, in a clear, visible and easily comprehensible manner, at least the following information:

  • the main characteristics of the proposed travel services (destination description, means of transport, type and category of accommodation, included meals etc.);
  • the total price of the package and all applicable taxes (airport taxes, local taxes etc.), as well as payment conditions;
  • information on passport and visa requirements, and any mandatory medical formalities;
  • the minimum number of participants required for certain programmes, where applicable;
  • cancellation and penalty conditions applicable to the traveller;
  • information regarding optional or mandatory insurance policies;
  • contact details of the tour operator and of the local representative, including for emergency situations;
  • the traveller’s right to transfer the contract to another person, under the conditions provided by law;
  • the right to a price reduction and/or compensation in the event of non-conformity;
  • the insolvency insurance of the tour operator.

This section is for informational purposes only and does not replace the Contract between EDESSENCE and participants, which details all rights and obligations of the parties.

  1. Cookie Policy

The Website uses cookies for optimal functionality and traffic analysis. Detailed information on the categories of cookies used, their duration and management methods are provided in the Privacy & Cookie Policy.

  1. Amendments to the Terms and Conditions

EDESSENCE reserves the right to modify or update this document at any time. The current version is published on the Website and becomes applicable as of its posting.

Continued use of the Website constitutes acceptance of such amendments.

  1. Governing Law and Dispute Resolution

These Terms and Conditions are governed by Romanian and European legislation.

Any dispute arising between the user and EDESSENCE shall be settled:

  1. primarily, amicably;
  2. subsidiarily, by the competent courts of Romania having jurisdiction over the registered office of EDESSENCE.
